B. Trademark Attribution

All other product names, trademarks, logos, and brands referenced on YTKits are the property of their respective owners and are used strictly for identification and descriptive purposes under fair use guidelines.

4. Acceptable Use Policy & Prohibited Conduct

You agree to use YTKits only for lawful purposes and in accordance with these Terms. You are strictly prohibited from engaging in any activity that harms, disrupts, or misuses our infrastructure or third-party APIs.

Prohibited Activities:

  1. Automated Scraping & Bot Abuse: Utilizing automated scripts, bots, spiders, crawlers, or scrapers to extract data, content, or API responses without explicit written consent.
  2. Rate Limit Circumvention: Attempting to bypass, manipulate, or breach API rate limits, IP restrictions, or access control mechanisms.
  3. Denial of Service Attacks: Performing actions that impose an unreasonable or disproportionately heavy load on our servers, CDNs, or database instances (e.g., DDOS attacks).
  4. Reverse Engineering: Decompiling, reverse engineering, disassembling, or attempting to discover the source code or underlying algorithms of YTKits proprietary code.
  5. Commercial Data Resale: Selling, licensing, renting, or commercially redistributing raw data or API results obtained from YTKits without prior written authorization.
  6. Malicious Activity: Transmitting malware, viruses, trojans, worms, or any code of a destructive or disruptive nature.

Violations of this Acceptable Use Policy may result in immediate IP blocking, account suspension, and referral to law enforcement authorities.

5. Accuracy of Data & Earnings Disclaimers

A. Revenue Estimates Are Not Guarantees

All revenue figures, RPM estimates, CPM benchmarks, and monthly/annual earnings projections displayed across YTKits are educational estimations only. Actual creator earnings on YouTube vary significantly based on multiple real-world factors, including:

  • Geographic region of viewers (Tier 1 vs. Tier 3 CPM rates).
  • Viewer ad-blocker usage rates and device types.
  • Niche ad demand, seasonality, and brand deal structures.
  • Channel monetizability state, YouTube Partner Program status, and copyright claims.

YTKits makes no representation or warranty that any channel will achieve the estimated earnings displayed on our site. Revenue projections should never be relied upon for financial, tax, or legal decisions.

B. Public Data & API Disclaimers

While YTKits strives to ensure real-time accuracy by polling official public APIs, we cannot guarantee that channel subscriber counts, view statistics, published dates, or tags will always be error-free or perfectly up to date. Data feeds depend on third-party API availability and public indexing delays.

6. Intellectual Property Rights

A. YTKits Ownership

All content, design assets, software code, UI layout, graphics, text, brand logos, tool interfaces, database schemas, and proprietary algorithms on YTKits are owned by or licensed to YTKits and are protected by international copyright, trademark, patent, and trade secret laws.

B. User License

Subject to your compliance with these Terms, YTKits grants you a personal, non-exclusive, non-transferable, revocable, limited license to access and use our website and tools for personal, non-commercial, or internal business research purposes.

7. Copyright Infringement & DMCA Notice Procedure

YTKits respects the intellectual property rights of others and expects users to do the same. In accordance with the Digital Millennium Copyright Act (DMCA), we respond expeditiously to copyright infringement notices.

If you believe that any content or artwork available on YTKits infringes upon your copyright, please submit a written DMCA Notice to our designated Copyright Agent containing the following information:

TO THE FULLEST EXTENT PERMISSIBLE UNDER APPLICABLE LAW, YTKITS DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
  • WARRANTIES THAT THE WEBSITE WILL BE UNINTERRUPTED, TIMELY, SECURE, ACCURATE, OR ERROR-FREE.

YOU ASSUME TOTAL RESPONSIBILITY AND RISK FOR YOUR USE OF YTKITS AND ANY RELIANCE PLACED ON DATA OBTAINED THROUGH OUR SERVICES.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL YTKITS, ITS DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNATIVE DAMAGES, INCLUDING WITHOUT LIMITATION:

  • LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES.

  • ANY BEHAVIOR OR CONTENT OF THIRD PARTIES ON THE SERVICE.
  • UNAUTHORIZED ACCESS, ALTERATION, OR USE OF TRANSMISSIONS OR DATA.

IN NO EVENT SHALL OUR AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE EXCEED ONE HUNDRED US DOLLARS ($100.00 USD) OR THE AMOUNT YOU PAID US (IF ANY) IN THE PAST TWELVE MONTHS.

You agree to defend, indemnify, and hold harmless YTKits, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or in any way connected with:

11. Account Termination & Service Modification

We reserve the right, in our sole discretion, to suspend, disable, terminate, or block access to YTKits for any user or IP address at any time, for any reason, including violation of these Terms, without prior notice or liability.

All provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

12. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with applicable laws, without regard to its conflict of law principles. Any legal action or proceeding arising under these Terms will be brought exclusively in competent courts of jurisdiction, and the parties hereby consent to personal jurisdiction and venue therein.
